What is Surrogate Motherhood?
Surrogate Motherhood is to carry another couple's child for the entire period of pregnancy and then give it to the other couple. This child and the surrogate mother may or may not share a genetic relationship, since the unrelated embryo can also be implanted in her womb. Now the question is are all women who are capable of reproduction become surrogate mothers. These are the qualifications that a surrogate mother should have.
What are the requirements to become a Surrogate Mother?
To become a Surrogate Mother the Qualities that a woman should have are as follows:
- The Surrogate should be in a healthy physical condition
- She should be more than eighteen years of age.
- Some agencies require that the surrogate should be a mother but there are others who do not have such demands.
- Surrogate should not be a patient of any sexually transmitted disease.
- She should also be a non-smoker and should also live in a smoke free environment.
- The individual should be psychologically prepared and should be ready to go through a physical and psychological test.
- It is better if the surrogate as a partner who can act as an emotional anchor and in case the surrogate has a partner he also has to go through physical and psychological tests.
- So these are the fundamental requirements of becoming a Surrogate Mother.
What is the process of Becoming a Surrogate Mother?
The process of becoming a Surrogate Mother is not very complex. Once you decide that you want to become one you can contact an agency who might do a background check, some physical and psychological tests for you in order to ensure that their clients know that the person carrying their baby comes from a good family and has healthy habits. Moreover to get you a couple who would be like minded about things related to the child can only be searched for if they know the background you come from. Once they have decided on one couple that match the requirements you have, they would arrange a meeting for of both the parties where you can meet the parents and they can meet you so that the decision-making becomes easier. After the meeting they would call both the parties to know if they like each other. With the assent of both the parties ends the initial formalities of the process.
Now a contract has to be made wherein it is ensured that all the parties get what they expect. Mostly the contract is made to ensure that the Surrogate mother gets medical expenses, her insurance and any other agreed payments.
Since 1997 ovum, sperm donation and surrogacy are legal in Georgia.
ANY PERSON,AT ANY AGE, WITH OR WITHOUT MARITAL STATUS CAN TAKE A SURROGATE MOTHER/EGG DONOR AND BECOME A PARENT.
According to the law a donor or surrogate mother has no parental rights over the child born.
According to the Georgian law, in case of the child born by a surrogate mother the couple/single person and not the surrogate mother will be registered as the parents/parent of the child. Even in case an embryo obtained from an egg or spermatozoon which was obtained not from the infertile couple but from a donor is transferred into the uterus of the surrogate mother, the couple will be deemed as the legal parents of the child. The birth certificate will be issued immediately after the child's birth, within 1 day. The couple/single person will be registered as the parents in the birth certificate. The surrogate mother will not be registered on the birth certificate. Thus a birth certificate of the child born by a surrogate mother does not differ from the birth certificate of any other children. Consent of the surrogate mother is not required for registration of the infertile couple/single person as parents. The following will be required for registration of the couple as parents: Surrogacy Agreement made by the couple, certificate of embryo transfer into the uterus of the surrogate mother issued by the IVF clinic and a birth certificate issued by maternity hospital. The procedure of issuance of the birth certificate is simple and does not require hiring a lawyer. The parents will have a right to take their child to their country any time after the child certificate has been issued (although you should check with your Embassy/Consulate on requirements for getting a passport for the baby).
Article 143. Extracorporeal fertilization (IVF) is allowed:
a) For the purpose of treatment of infertility, as well as in case of risk of transmission of genetic disease on a wife's or a husband's part, by using sex cells or an embryo of the couple or a donor, if the couple's written consent has been obtained.
b) If a woman has no uterus, for the purpose of transfer and growth of the embryo obtained as a result of fertilization to the uterus of another woman ("surrogate mother"). The couple's written consent is obligatory.
The couple is considered to be parents in case of the childbirth with the responsibility and authority ensuing from it. A donor or a "surrogate mother" has no right to be recognized as a parent of the born child.
For the purpose of artificial fertilization it is possible to use female and male sex cells or an embryo conserved by the method of freezing. The time of conservation is determined according to the couple's need.
